Government Interference
HB 6205, The Reproductive Health and Access Act (RHAA), bars government entities in Illinois from interfering with an individual’s right to access reproductive health care (access to contraception, access to abortion or the right to carry a pregnancy to term). If a government entity interferes with a persons’ rights, that person can go to court for redress.
- Example: A county board bans the local health department from providing information or referrals about abortion. It requires staff to only provide referrals to a crisis pregnancy center.
- Example: A city council passes a zoning ordinance that prohibits abortions from being performed within the city limits.
- Example: A judge orders a woman to be sterilized as part of her criminal sentencing.
- Example: A county board prohibits the county public hospital’s emergency room from providing emergency contraception to rape victims.
